Terms of Use

Effective date: [date of publication] · Version 1.1 · Your Digital Innovation GmbH

1. Introduction

Welcome to ReachYourGoal.AI (the "Service", the "App"), a 30-day AI training program that teaches everyday users how to work with modern AI tools, operated by Your Digital Innovation GmbH, a company incorporated under Austrian law, with its registered office in Vienna, Austria ("YDI", "we", "us", "our").

These Terms of Use ("Terms") form a binding legal agreement between you ("User", "you", "your") and YDI, governing your access to and use of ReachYourGoal.AI across all editions: App Store (Consumer), Business, Business + and Corporate / City.

By downloading, installing, accessing or using the App, you accept and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

3. Acceptance and Eligibility

3.1 Age

You must be at least 16 years old to use the Service, or the minimum digital-consent age of your jurisdiction, whichever is higher. If you are between 13 and the minimum age, you may only use the Service with verified consent from a parent or legal guardian.

3.2 Legal Capacity

If you accept these Terms on behalf of a company, municipality or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3.3 Global Availability

ReachYourGoal.AI is provided as a worldwide service. You are responsible for ensuring your use of the Service complies with the laws of your jurisdiction. We may restrict availability of certain features or Editions in specific countries.

4. Editions and Feature Scope

ReachYourGoal.AI is offered in four Editions matching different buyer contexts. Feature availability may evolve over time.

4.1 App Store (Consumer) Edition

4.2 Business Edition (2 – 49 seats)

4.3 Business + Edition (49 – 500 seats)

4.4 Corporate / City Edition (500 + seats)

4.5 Changes to Features

We may add, modify or remove features across any Edition to improve the Service, respond to legal or security requirements or reflect commercial availability. Material adverse changes to paid Editions will be communicated in advance.

5. Accounts and Security

5.1 Registration

Some features require an Account. You agree to provide accurate, current information and to keep it up to date.

5.2 Credentials

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your Account. Notify us immediately of any unauthorized access.

5.3 Buddy System and Codes

The App may offer a buddy or referral system with codes and cashback rewards. Any such rewards are subject to fair-use rules; abuse (e.g., fake accounts, self-referrals, coordinated fraud) will result in reversal of rewards and possible Account termination.

6. Subscriptions, Fees and Payment

6.1 Pricing

Current prices for the Pro, B2B and City Editions are displayed in the App or in an Order Form. Prices may be listed in EUR, USD or the User's local currency and may be subject to VAT, GST or other taxes.

6.2 Billing Cycles

The App Store Edition is a one-time purchase (€ 19) granting lifetime access to the 30-day training program and its lifetime updates. Business, Business + and Corporate / City Editions are billed based on the applicable Order Form (per seat). Optional Community Credit packages are billed separately per volume.

6.3 Auto-Renewal

Paid subscriptions renew automatically at the end of each billing cycle unless cancelled prior to renewal. You may cancel at any time in the App or by contacting support; cancellation takes effect at the end of the then-current billing cycle.

6.4 Refunds

Except where required by mandatory law (including the EU statutory right of withdrawal, which you may waive upon immediate activation of a digital subscription), fees are non-refundable. Municipal (City) contracts are governed by the specific Order Form and applicable public-procurement rules.

6.5 Trials, Cashback and Promotions

Free trials, promotional codes, buddy cashback and similar benefits may be offered subject to specific rules communicated at the time of the offer. Cashback is credited to the User's Account or paid out according to the payout rules in effect.

6.6 Payment Processing

Payments are processed by third-party payment providers. We do not store your full card details. Your payment relationship with these providers is subject to their terms.

7. Acceptable Use

You agree not to:

For B2B and City Editions, Organization Admins are responsible for ensuring that Members' use complies with these Terms.

8. User Content and Community Features

ReachYourGoal.AI provides Community Features that let you interact with other Users. This Section 8 sets the rules for User Content and community behaviour. It complements Section 7 (Acceptable Use).

8.1 What You Can Post

Depending on your Edition, you may post the following types of User Content:

Some post types may be restricted to certain Editions (for example, Free Users may have read-only access to some Community Features).

8.2 Rules for User Content

By posting User Content, you represent, warrant and agree that your User Content:

8.3 Interactions Between Users (Comments, Ratings, Notifications)

Community Features let you react to and interact with other Users' User Content:

You are responsible for your interactions with other Users. YDI is not obliged to mediate disputes between Users but may act on reports where these Terms are violated.

8.4 Licence in User Content

You retain ownership of your User Content. By posting User Content, you grant YDI a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, cache, reproduce, publish, distribute, publicly display, publicly perform, translate, adapt, modify (for formatting and moderation purposes) and use your User Content, for the purpose of operating, securing, promoting and improving the Service and the Community Features.

You also grant each other User a non-exclusive, worldwide, royalty-free licence to access your User Content and to use, reproduce, distribute, display and perform it as permitted by the functionality of the Service (for example, quoting, replying, sharing within the Community).

These licences terminate for future use when you delete your User Content or your Account, except that (i) YDI may retain reasonable backup and archival copies for legal, security and integrity purposes, and (ii) copies of your User Content that other Users have already reproduced or shared may persist independently.

8.5 Content Moderation

YDI has the right, but not the obligation, to review, monitor, edit (for formatting), refuse, restrict, hide, remove or reorder User Content at any time, at our discretion, in particular where User Content:

We may use a combination of automated systems (including AI-based classifiers) and human review to moderate content. Automated decisions of a significant nature can be reviewed by a human on request, in line with applicable law (including Art. 22 GDPR and the EU Digital Services Act, where applicable).

Removal of User Content is not an admission by YDI that the Content was unlawful. Conversely, keeping User Content visible does not constitute endorsement.

8.6 Reporting Inappropriate Content

If you believe that User Content violates these Terms, third-party rights or applicable law, please use the in-app report function or contact jg@yourdigitalinnovation.com. Please provide sufficient information to allow us to assess the report (identification of the Content, the alleged violation, and any supporting information). We handle reports in good faith and act on them within a reasonable time.

Copyright complaints: notices under the U.S. Digital Millennium Copyright Act (DMCA) or equivalent notices under Art. 17 CDSM Directive can be sent to jg@yourdigitalinnovation.com with the information required by the applicable law.

8.7 Suspension and Termination for Inadequate Content

Without limiting Section 13 (Termination), we may, at our sole discretion, take one or more of the following actions where a User posts inadequate User Content, breaches Section 7 or Section 8, or otherwise behaves in a manner that harms the Community:

We may take these actions immediately and without prior notice where reasonably necessary to prevent serious harm, comply with law, or protect Users, YDI or third parties. Otherwise, we will typically inform the affected User of the action, the main reason, and, where the User remains on the Service, how to appeal.

8.8 Appeal

If your User Content has been removed or your Account has been restricted, suspended or terminated, you may appeal by contacting jg@yourdigitalinnovation.com within 30 days. We will review the appeal in good faith and respond within a reasonable time. Where required by the EU Digital Services Act or equivalent law, we will provide access to an out-of-court dispute settlement body.

8.9 No Endorsement; Independent Views

User Content reflects the views of the User who posted it, not of YDI. AI News, AI Use Cases and answers to Questions are not verified by YDI and must not be relied on as professional advice.

9. AI Features, Third-Party Models and Outputs

9.1 Third-Party AI

ReachYourGoal.AI integrates with third-party AI models (including but not limited to Anthropic's Claude and other providers) to generate text, summaries, coaching, plans and other AI outputs. Availability of specific models may change.

9.2 Nature of AI Outputs

AI outputs are generated by statistical models and may be inaccurate, incomplete, biased or otherwise inappropriate. AI outputs are not professional advice (medical, legal, financial, psychological or otherwise). You are responsible for evaluating the accuracy and suitability of any AI output before acting on it.

9.3 Ownership of AI Outputs

As between you and YDI, you own the AI outputs generated on your behalf through your use of the Service, subject to (i) any third-party rights, (ii) our right to use aggregated and de-identified data to operate and improve the Service, and (iii) restrictions in the third-party AI providers' terms.

9.4 Prohibited AI Uses

You may not use the AI features to generate content that violates Section 7 or Section 8, infringes third-party rights, or attempts to extract or reveal training data, system prompts or confidential model behaviour.

10. Intellectual Property

10.1 Ownership

The Service, including software, design, content curated by YDI, trademarks (including "ReachYourGoal.AI"), logos and know-how, is owned by YDI or its licensors. All rights not expressly granted are reserved.

10.2 Licence to You

Subject to these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal purposes (personal, employee training or citizen engagement, depending on the Edition).

10.3 Your Content

Ownership of and licence to your Content are addressed in Section 8.4 (User Content) for Content shared through Community Features, and, for private Content that is not shared, you retain full ownership and grant us only the operational licence necessary to store and process it in order to provide the Service to you.

10.4 Feedback

If you provide feedback or suggestions, you grant YDI a perpetual, irrevocable, royalty-free right to use them for any purpose without obligation to you.

11. Third-Party Services and Integrations

ReachYourGoal.AI may integrate with third-party services (AI providers, payment processors, calendars, SSO providers, cloud infrastructure). Your use of those services is subject to their terms. We are not responsible for third-party services or their availability.

12. B2B and City Edition Specifics

12.1 Organization Responsibility

Organization Admins are responsible for (a) informing Members about their use of the Service, (b) obtaining any consents required by applicable law, and (c) configuring goals, KPIs and programs in a manner compatible with employment, works-council and public-administration rules.

12.2 Data Processing Agreement

Where YDI processes personal data on behalf of an Organization (e.g., for B2B employees or City citizens), the parties will enter into a Data Processing Agreement ("DPA") in accordance with Art. 28 GDPR and equivalent laws. The DPA prevails over these Terms with respect to such processing.

12.3 Organization-Specific Community

For B2B and City Editions, the Organization Admin may enable or disable Community Features, restrict them to an internal community within the Organization, or configure separate moderation rules. Where the Organization enables cross-Edition community access, Users acknowledge that their User Content may be visible to Users outside the Organization.

12.4 Order Form Precedence

In case of conflict between an executed Order Form (or Master Services Agreement) with an Organization and these Terms, the Order Form prevails for that Organization.

13. Confidentiality

Non-public information that either party marks or should reasonably understand to be confidential ("Confidential Information") must be protected with reasonable care and used only to fulfil these Terms. This obligation survives termination for three (3) years, and indefinitely for trade secrets.

14. Termination

14.1 By You

You may stop using the Service and delete your Account at any time. Deletion of your data is governed by the Privacy Policy and, for Organization Members, by the applicable DPA.

14.2 By Us

We may suspend or terminate your access if you materially breach these Terms (including Section 7 and Section 8), post inadequate User Content, use the Service in a way that harms YDI or other Users, or if required by law. Where reasonable, we will provide notice and an opportunity to cure. In cases of serious or repeated breaches, immediate termination without cure is permitted.

14.3 Effect of Termination

Upon termination, your right to use the Service ends. Your User Content may be removed or hidden. Sections that by their nature should survive (e.g., licences granted under Section 8.4, IP, Confidentiality, Liability, Governing Law) survive termination.

15. Disclaimers

THE SERVICE, INCLUDING USER CONTENT AND AI OUTPUTS, IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, YDI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF AI OUTPUTS OR USER CONTENT, AND UNINTERRUPTED AVAILABILITY.

Nothing in these Terms excludes liability that cannot be excluded under mandatory law (including consumer protection, gross negligence, wilful misconduct, or personal injury caused by negligence).

16. Limitation of Liability

To the maximum extent permitted by law, YDI is not liable for indirect, incidental, consequential, special or punitive damages, or for loss of profits, revenues, goodwill or data. In particular, YDI is not liable for damages arising from User Content posted by other Users.

YDI's aggregate liability for all claims arising out of or related to the Service in any twelve (12) month period is limited to the greater of (a) the fees paid by you to YDI in that period, or (b) EUR 100.

This limitation does not apply to liability for wilful misconduct, gross negligence, personal injury caused by negligence, or where liability cannot be limited by law.

17. Indemnification

You will defend and indemnify YDI against third-party claims arising from your User Content, your breach of these Terms, or your unlawful or infringing use of the Service. This obligation does not apply where mandatory law provides otherwise (e.g., for consumers acting outside their trade or profession).

18. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email at least fourteen (14) days before they take effect. Your continued use after the effective date constitutes acceptance. If you disagree, you may stop using the Service and cancel any paid subscription.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

Exclusive place of jurisdiction for all disputes is the competent court in Vienna, Austria, to the extent legally permissible. Consumers may also sue and be sued in the jurisdiction of their habitual residence, and mandatory consumer-protection laws of their country of residence remain unaffected.

For B2B and City customers under a separate Order Form, the governing-law and jurisdiction clauses of that Order Form prevail.
